This Privacy Policy explains how Atkins Health Pty Ltd, trading as Atkins Health (we, us, our), handles personal information when you use the Atkins Health Hub mobile application (App).
We are an Australian allied health provider. The App is designed for existing clients and patients who have been given an account by us. You cannot create a new account directly within the App.
The App allows you to:
- log in to your existing client account;
- view, book and cancel eligible classes or appointments;
- access invoice PDFs for your own records and private health insurance claims; and
- manage limited account-related functions connected to your care with us.
We take the privacy of our clients and patients seriously, particularly because we handle health information.
1. Information we handle through the App
The App uses information that we already hold about you as an existing client or patient, as well as limited information generated when you use the App.
This may include:
- your name and contact details;
- your date of birth or other details needed to identify your account;
- your client or patient account details;
- appointment and class booking information;
- cancellation history and attendance-related information;
- invoice PDFs and billing information;
- information about services provided to you by us;
- login and authentication information;
- basic technical information such as device type, operating system, app version, IP address, usage logs and error logs; and
- communications you send to us about the App or your account.
Some of this information may be health information or otherwise sensitive information because it relates to allied health services provided to you.
2. Information we do not collect through the App
Unless we tell you otherwise and update this Privacy Policy, the App does not intentionally collect:
- precise GPS location;
- contacts from your device;
- photos or videos from your device;
- microphone recordings;
- camera data;
- advertising identifiers for advertising purposes;
- information for third-party advertising; or
- information for third-party tracking.
The App is not designed to collect new clinical notes, medical history or treatment information directly from you. That information is handled through our usual clinical intake, consultation and administration processes.
3. How we collect information
We may collect or access information:
- from our existing client and patient records;
- when your account is created or managed by our team;
- when you log in to the App;
- when you book, change or cancel a class or appointment;
- when you view or download an invoice PDF;
- when you contact us for support; and
- automatically through technical logs required to operate, secure and maintain the App.
4. How we use your information
We use your information to:
- verify your identity and allow you to log in;
- provide access to your existing client account;
- allow you to book, manage and cancel eligible classes or appointments;
- provide invoice PDFs for your records and private health insurance claims;
- manage our relationship with you as a client or patient;
- provide administrative and support services;
- maintain the security, integrity and reliability of the App;
- investigate errors, faults, misuse or unauthorised access;
- meet our legal, professional, clinical, insurance, billing and record-keeping obligations; and
- improve the functionality and reliability of the App.
We do not use information from the App for third-party advertising or third-party tracking.
5. Sharing your information
We do not sell, rent or trade your personal information.
We do not share your personal information with third parties for advertising or marketing purposes.
We may disclose personal information only where reasonably necessary for our allied health services, administration, legal obligations or operation of the App. This may include disclosure to:
- our employees, clinicians, contractors and administrative team members who need access to perform their role;
- technology providers who help us operate, host, maintain or secure the App and our client systems;
- professional advisers, insurers or auditors where required;
- government, regulatory or law enforcement bodies where required or authorised by law; and
- another healthcare provider, insurer or representative where you have requested or authorised the disclosure, or where disclosure is otherwise permitted by law.
We do not submit private health insurance claims on your behalf through the App. The App provides invoice PDFs so you can make your own claim directly with your private health insurer.
6. Third-party services and platforms
The App may rely on secure technology systems and service providers to operate, including hosting, authentication, storage, software maintenance, app distribution and security services.
Where we use service providers, we take reasonable steps to ensure they handle personal information securely and only for the purpose of providing services to us.
Apple, Google and your device operating system may also collect information independently when you download, install or use the App. Their handling of information is governed by their own privacy policies and platform terms.
7. Data security
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.
These steps may include:
- account-based access controls;
- secure login processes;
- encryption in transit where appropriate;
- restricted staff access;
- system monitoring and logging;
- administrative, technical and physical security measures; and
- staff training and confidentiality requirements.
No method of electronic transmission or storage is completely secure. However, we take privacy and security seriously and work to protect the information we hold.
8. Data retention
We keep personal information for as long as needed to provide allied health services, operate the App, manage our business, comply with legal and professional obligations, resolve disputes and maintain accurate clinical, billing and administrative records.
Because we are a health service provider, we may be required to retain certain clinical, billing and administrative records for minimum legal or professional record-keeping periods.
When information is no longer required, we take reasonable steps to securely delete, destroy or de-identify it.
9. Accessing or correcting your information
You may request access to personal information we hold about you. You may also ask us to correct information if you believe it is inaccurate, incomplete or out of date.
To make a request, contact us using the details below.
We may need to verify your identity before responding. In some cases, we may be unable to provide access to certain information, such as where access would affect another person’s privacy, breach legal obligations or compromise clinical, security or business records. If this occurs, we will explain the reason where appropriate.
10. Account access and deletion requests
The App is only available to existing clients and patients with an account created by us.
If you no longer want access to the App, you can contact us and ask us to disable your App account access.
Disabling App access does not necessarily delete all information we hold about you. We may need to retain clinical, billing, administrative, legal or security records where required or permitted by law.
If you ask us to delete information, we will consider your request and delete information where we are legally able to do so. Where we must retain information, we will explain this where appropriate.
11. Children and young people
The App is intended for existing clients and patients of our allied health services.
Where the App is used by or on behalf of a child or young person, account access should be managed by the child’s parent, guardian or authorised representative where required.
We do not knowingly allow children to create their own accounts directly through the App.
12. Overseas disclosure
We aim to handle personal information within Australia where reasonably practicable.
Some technology providers used to operate, host, support or secure the App may store or process information outside Australia. Where this occurs, we take reasonable steps to ensure appropriate privacy and security protections are in place.
13. Marketing
We do not use the App for third-party advertising or tracking.
We may send you service-related communications about your account, bookings, classes, appointments, invoices or important operational updates.
We will only send marketing communications where permitted by law. You can opt out of marketing communications by following the unsubscribe instructions or contacting us.
14. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to the App, our services, legal requirements or privacy practices.
The updated version will be made available through our website, the App or the relevant app store listing. The “Last updated” date will show when the policy was most recently changed.
